Gift Mate Terms of Use

These Terms govern the use of the giftmate.online website, the @gift_mate_bot bot, the Gift Mate browser extension for Chrome, and related Gift Mate features (the Service).

1. Service Owner

The owner of the Service is Konstantin Nikolaevich Poklonskii (Поклонский Константин Николаевич), an individual applying the Russian special tax regime “Tax on Professional Income” (self-employed/NPD).

2. Acceptance of the Terms

By beginning the sign-in process, creating an account, or continuing to use the Service after being given an opportunity to review these Terms, the user accepts them and enters into an agreement with the Service owner for the use of Gift Mate.

No separate mandatory checkbox is used for personal-data processing. Processing necessary to enter into and perform this agreement is described in the Personal Data Processing Policy. Separate consent is requested only for independent optional purposes where required by law, such as future marketing messages.

If the user does not agree to these Terms, the user must not sign in or use the Service.

3. Age

The Service is intended for persons aged 18 or older. By using Gift Mate, the user confirms that they are an adult and have the legal capacity to enter into this agreement.

4. Service Features

Gift Mate helps users store wishlists, gift ideas, notes, preferences, and event dates, receive reminders, and use other related features. The Service is available on the giftmate.online website, through the @gift_mate_bot bot as a notification channel, and through the Gift Mate extension for Chrome, which saves a product from an open page to the user's wishlist or to gift ideas for someone close to them. Features may be changed, added, temporarily suspended, or removed as the project develops.

Use of the extension is voluntary and is not required for the rest of the Service to work. The extension works only with the account the user has connected to it and can be disconnected in the profile on the site — the “Активные входы” (Active sign-ins) section. The data the extension reads and transmits is described in the Personal Data Processing Policy.

The Service is an independent project and is provided in its current form. The owner takes reasonable steps to keep it available but does not guarantee uninterrupted operation, absence of errors, or preservation of any particular set of features.

5. Account

The user must provide accurate information to the extent needed for the account and must keep the selected means of sign-in secure. A user may not give another person access credentials or use another person's account without permission.

Actions performed following successful authentication are treated as the user's actions until the owner receives notice of possible unauthorised access. If such access is suspected, contact support@giftmate.online.

6. User Content

Rights in information and materials added by a user remain with the user or their lawful rightsholder. The user grants the Service owner a non-exclusive, royalty-free right to process that content technically only to the extent and for the period necessary to operate the Gift Mate features selected by the user, including storing it, displaying it to the user, and publishing a public wishlist chosen by the user.

The user is responsible for the content they add and for having the rights or other lawful grounds needed to use it. Gift Mate does not review all user content in advance.

7. Information About Other People

A user may enter limited information about close persons for personal gift and event planning. The user must respect those persons' rights and reasonable expectations, must not enter information without a lawful basis, and must not store special categories of data or clearly excessive information.

If the user receives a justified request from the person concerned to remove information about them, the user must do so. The person may also contact Gift Mate support.

8. Public Wishlists

A user may make only their own wishlist accessible through a link. The public page contains the wishlist title and the products added by the user, together with related information or links. A visitor also sees that a wish is already reserved but not who reserved it; the owner of the list is not shown reservations at all.

The user's name is not shown on that page to outsiders — only the owner and users already connected to them see it. The Service does, however, compose the wishlist title and the page address from the user's name by default: the user can change the title at any time and decides what it contains.

Anyone who receives the public link may open it and share it further. The user decides what to include in the public title and product cards and must not place another person's personal data, unlawful content, or information they do not want disclosed to an indefinite number of people there.

Gift Mate has no feature for publishing a close person's wishlist. Names of close persons, event dates, notes, preferences, and related gift ideas do not become public through the public-wishlist feature.

9. Advertising and Affiliate Links

Gift Mate currently contains no advertising materials and no affiliate links: links to shops are ordinary links without affiliate parameters, and the owner of the Service receives no compensation for them.

Should that change, this section will be updated before any such advertising or links appear. Where advertising laws require advertising labels or reporting to relevant government systems, those requirements are followed.

Advertising and marketing communications by email, Telegram, push notifications or other channels are sent only where there is an appropriate lawful basis and, where required by law, separate user consent.

11. Links, Products, and Third-Party Services

Gift Mate may display links to products, stores, sign-in methods, and other third-party resources. Those resources operate under their own terms. Gift Mate is not the seller of displayed products, does not enter into purchase contracts on the user's behalf, and is not responsible for availability, price, quality, delivery, or the conduct of a third-party resource.

Before making a purchase, the user must independently check the seller, product characteristics, and transaction terms.

12. Artificial Intelligence Features

Outputs from artificial-intelligence-based features are generated automatically and may be inaccurate, incomplete, or unsuitable. They are provided as ideas and are not professional advice. The user must independently review an output before relying on it or sharing it with another person.

Users should not submit confidential information or special categories of personal data to these features.

13. Reminders

Reminders are delivered when technically possible and may be delayed or not delivered because of device settings, network conditions, or third-party services. Gift Mate should not be used as the sole reminder for an event that must not be missed.

14. Access Restrictions

The owner may temporarily restrict or terminate a user's access if the user materially breaches these Terms, creates a security risk, harms other users, or if a restriction is required by law. Where reasonable and not likely to create additional risk, the user will be given an opportunity to remedy the breach.

15. Ending Use and Deletion

The user may stop using Gift Mate at any time and delete the account using the method available in the Service or through support.

Once the account deletion command is carried out, the account and associated data are deleted immediately and cannot be restored. Gift Mate does not create backups of user data, so deleted data is not retained in backup copies. The only exceptions are de-identified usage statistics and information that the owner must retain by law or that is necessary to address a dispute that has already arisen; its use is restricted to that purpose.

16. Liability

The Service is provided “as is” to the extent permitted by applicable law. The owner does not guarantee that the Service will meet every individual expectation of a user.

To the extent permitted by law, the owner is not liable for indirect losses or the consequences of the user's decisions, including consequences of an undelivered reminder, an automatically generated suggestion, a visit to a third-party resource, or the actions of a person who received a public link from the user or another person.

Nothing in these Terms excludes or limits liability that cannot be excluded by law or reduces mandatory consumer rights.

17. Changes to the Terms

These Terms may be updated when the Service or the law changes. The current version is published at https://giftmate.online/terms and states its revision date.

Material changes apply to continued use of the Service after notice has been provided by an available method and the specified effective date has arrived, unless the law requires another procedure. If the user does not accept a change, the user may stop using the Service and delete the account before it takes effect.

18. Governing Law and Disputes

These Terms are governed by the laws of the Russian Federation. Before going to court, the parties will attempt to resolve a dispute by contacting support@giftmate.online. This does not restrict the user's right to contact a public authority or court or to use mandatory consumer remedies.
